Welcome to Campfire Music Collective. By accessing or using our website (https://www.campfiremusiccollective.com) (the "Site"), you agree to comply with and be bound by these Terms of Use. If you do not agree with these terms, please do not use the Site.

1. Acceptance of Terms

By accessing the Site, you confirm that you are at least 18 years old or have the legal capacity to enter into this agreement. If you are using the Site on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Important: These Terms of Use govern your general use of the Site. If you enroll in a membership program with us, additional terms and conditions will apply as set forth in our Studio Guide, which will be provided to you upon enrollment.

2. About Campfire Music Collective

The Site is owned and operated by Boise Music Lessons LLC, doing business as Campfire Music Collective ("Campfire Music Collective," "we," "our," or "us"). We provide music education services, including lessons, classes, events, and educational resources for adults and families.

3. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the modified Terms.

4. Use of the Site

a. Permitted Use

You agree to use the Site only for lawful purposes and in accordance with these Terms.

b. Prohibited Conduct

You are prohibited from:

  • Posting or transmitting harmful, offensive, threatening, defamatory, or illegal content

  • Engaging in unauthorized access, hacking, data mining, scraping, or similar activities

  • Using the Site to distribute spam, malware, viruses, or other harmful software

  • Impersonating any person or entity or misrepresenting your affiliation with any person or entity

  • Interfering with or disrupting the Site or servers connected to the Site

  • Violating any applicable local, state, national, or international law

5. Intellectual Property

a. Our Content

All content on the Site, including but not limited to text, graphics, logos, images, music arrangements, course materials, videos, tutorials, the "Song Cycle Method," and software, is the property of Boise Music Lessons LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

b. Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the Site without our prior written consent, except as follows:

  • You may print or download one copy of a reasonable number of pages for your personal, non-commercial use

  • If you are a member, you may access and use course materials in accordance with your membership terms

c. Proprietary Methods

Our "Song Cycle Method," custom song arrangements, and curriculum materials are proprietary to Campfire Music Collective and are protected by copyright. Unauthorized reproduction, distribution, or commercial use of these materials is strictly prohibited.

6. User-Generated Content

a. License Grant

If you submit content to the Site (e.g., through contact forms, comments, reviews, testimonials, or other communications), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.

b. Your Responsibilities

You are solely responsible for any content you submit and must ensure it:

  • Does not violate any laws or regulations

  • Does not infringe upon any third-party rights (including intellectual property, privacy, or publicity rights)

  • Does not contain harmful, offensive, or inappropriate material

  • Is accurate and not misleading

c. No Obligation

We have no obligation to monitor user-generated content but reserve the right to review, edit, or remove any content at our sole discretion.

7. Membership Programs

a. Separate Terms

If you enroll in one of our membership programs (including seasonal memberships, annual memberships, or Campfire Club), you will be subject to additional terms and conditions as outlined in our Studio Guide. The Studio Guide governs all aspects of your membership, including:

  • Event scheduling and attendance

  • Tuition and payment terms

  • Cancellation and refund policies

  • Use of Learning Management Systems (LMS)

  • Code of conduct

b. Age Requirements

Our membership programs are designed for adults (18+) and families with children ages 10 and up. Children ages 10-17 must be enrolled by a parent or legal guardian who agrees to these Terms and the Studio Guide on the child's behalf.

8. Learning Management Systems

As part of our services, we utilize third-party Learning Management Systems (LMS). Your use of any LMS is subject to both these Terms and the LMS provider's terms of service and privacy policy. We are not responsible for the functionality, availability, or security of third-party LMS platforms.

9. Payment and Fees

a. General

Certain features or services on the Site may require payment. All fees are non-refundable unless otherwise stated in our Studio Guide or required by law.

b. Third-Party Payment Processors

We use third-party payment processors to handle all payment transactions. By providing payment information, you agree to the terms and conditions of our payment processors. We do not store your complete payment card information.

10. Third-Party Links and Affiliate Disclosure

a. Third-Party Links

The Site contains links to third-party websites, including retailers, music equipment vendors, and other service providers. We are not responsible for the content, privacy practices, accuracy, or policies of third-party sites. Accessing such sites is at your own risk.

b. Amazon Associates

Campfire Music Collective is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com. We may earn a small commission on purchases made through affiliate links at no additional cost to you.

11. Disclaimer of Warranties

THE SITE AND ALL CONTENT, SERVICES, AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CAMPFIRE MUSIC COLLECTIVE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT

  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT

  • WARRANTIES THAT THE SITE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED

We do not guarantee that:

  • The Site will meet your requirements

  • The Site will be available at all times or without interruption

  • Any errors or defects will be corrected

  • The Site or its servers are free of viruses or other harmful components

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BOISE MUSIC LESSONS LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

  • LOSS OF PROFITS, REVENUE, DATA, OR USE

  • BUSINESS INTERRUPTION

  • PERSONAL INJURY OR PROPERTY DAMAGE

ARISING OUT OF OR RELATED TO:

  • Your use of or inability to use the Site

  • Any content obtained from the Site

  • Unauthorized access to or alteration of your data or communications

  • Any other matter relating to the Site

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. Indemnification

You agree to indemnify, defend, and hold harmless Boise Music Lessons LLC, Campfire Music Collective, and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

  • Your use of the Site

  • Your violation of these Terms

  • Your violation of any third-party rights, including intellectual property, privacy, or publicity rights

  • Any content you submit or transmit through the Site

14. Termination

a. By Us

We reserve the right to terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms

  • Conduct that we believe is harmful to other users, us, or third parties

  • Requests by law enforcement or other government agencies

  • Discontinuation or material modification of the Site

b. By You

You may stop using the Site at any time. If you are a member and wish to cancel your membership, please refer to the cancellation terms in the Studio Guide.

c. Effect of Termination

Upon termination, your right to use the Site will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

15. Dispute Resolution

a. Informal Resolution

Before filing any formal legal action, you agree to first contact us at campfiremusiccollective@gmail.com to attempt to resolve any dispute informally.

b. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law provisions.

c. Jurisdiction and Venue

Any disputes arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Ada County, Idaho. You consent to the personal jurisdiction of such courts and waive any objection to venue.

16. Miscellaneous

a. Entire Agreement

These Terms, together with our Privacy Policy and (if applicable) Studio Guide, constitute the entire agreement between you and Campfire Music Collective regarding your use of the Site.

b. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

c. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

d. Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

e. No Agency

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Campfire Music Collective.
